Liability, Waiver of Claims, and Indemnity Agreement

Definitions:

Property-Owners (Owners of Box Canyon Rental Properties LLC)

I/We (All Persons Renting at Reserved RV Site or House Rental)

 

Release of Liability, Waiver of Claims, and Indemnity Agreement.

1. I/We agree to hold the Property-Owners harmless and indemnify them in conjunction with regard to any illness, injury, disability, death, or loss or damage to person or to my own personal property, whether caused by negligence or otherwise.

2. I/We hereby release the Property-Owners, their representatives, agents, volunteers, and other vessels from any and all liability, responsibility, and claims on their estate, heirs, survivors, executors, or assigns may have for personal injury, property damage, or wrongful death arising from activities whether caused by active or passive negligence of the Property-Owners or otherwise.

3. I/We am/are not relying on any oral or written representation or statements made by the Property-Owners other than that set forth in this agreement.

Express Assumption of Liability Associated with Recreational Activities.

The description of the hazards and risks listed below is in no way complete and that all such dangers, both anticipated and unanticipated, can lead to illness, injury, permanent disability, drowning and death.

I/We Agree:

1. Injuries sustained from any and all outdoor activities, such as walking, running, jumping, hiking, biking, climbing, camping, cooking, engaging in sporting events such as volleyball, soccer, horse shoes, badminton, croquet, etc.

2. Injuries sustained from objects that are either natural or man-made, such as rocks, cliffs, logs, trees and campfires, or from misjudging trails or other terrain that induces slipping, falling, colliding or otherwise.

3. Injuries and illnesses sustained from natural disasters, like fire, rain, hail, wind, heat, snow, ice, etc.

4. Injuries from hypothermia, heat stroke, dehydration, etc. from exposure to the elements, such as rain, cold, excessive heat or the weather in general.

5. Physical and monetary injuries sustained due to my own personal negligence and/or the negligence of others, altercations with other patrons, the excessive use of alcohol, the prohibited use of illegal drugs, and the like.

6. Injuries or illnesses sustained from either plants or animals, such as poison ivy, poison oak, poison sumac, aggressive or biting pets, service animals, wildlife, or exposure to any plants or animals present within the camping area in general.

 

Parent or Legal Guardian Agreement.

As the parent(s) or legal guardian(s) you are fully and lawfully responsible for all the attendee(s) traveling with you:

1. I/We understand that minor(s) is/are not to wander throughout the RV property unattended.

2. I/We understand that minor(s) must be accompanied by his/her parent(s) or legal guardian(s) at all times

3. I/We take full responsibility for myself, my heirs, assigns, and next of kin involvement in any activities.

4. I/We therefore consent and agree to release and indemnify the Property-Owners from any and all liability.

 

This release shall be binding to the fullest extent permitted by law. If any provision of this release is found to be unenforceable, the remaining terms shall still be enforceable:

I/We have read and agree with the "Express Assumption of Risk Associated with Recreational Activities", "Parent and Legal Guardian Agreement", and "Release of Liability, Waiver of Claims, and Indemnity Agreement". I/We fully understand it’s terms, and freely and voluntarily under my/our own free will without any inducement, coercion or otherwise and agree to the terms listed in this document and release the Owners of Box Canyon Rental Properties LLC from any and all responsibility as stated in this legal document and therein relinquish my/our legal rights by replying “Yes” to the RV Reservation, Liability, Claims of Waiver, Indemnity Agreement text that I received from the Property-Owners.
